01 The Divergence Acceleration
In 2000, the policy gap between the most liberal and most conservative state was about 4 points on a composite index measuring abortion, guns, labor, healthcare, environment, and voting. In 2024, that gap is 16 points. States aren't just disagreeing — they're actively building different legal frameworks. A person in California and a person in Texas now live under fundamentally different systems of rights and obligations.
02 The Abortion Litmus Test
No policy area has diverged faster. Before 2022, every state operated under Roe v. Wade. After Dobbs, the range is total ban (Texas, Idaho) to full access with state-funded travel (California, Oregon). This creates an unprecedented situation: a constitutional right that exists in some states and is criminalized in others, with no federal floor.
03 The Sorting Effect
As states diverge, Americans are sorting themselves. Internal migration data shows people increasingly move to states that match their political preferences. This creates a feedback loop: as liberal states get more liberal and conservative states get more conservative, the gap widens further. The result is two nations sharing a border, an army, and a currency, but little else.
